Landmark Victory: AMP’s Executive Director Wins in Federal Court
In a resounding victory, a federal court has ruled that the Department of Homeland Security (DHS) violated American Muslims for Palestine Executive Director Dr. Osama Abu Irshaid’s Fourth Amendment rights. The ruling stems from two incidents in 2024 in which Customs and Border Protection (CBP) agents seized Dr. Abu Irshaid’s devices to conduct “advanced” searches upon his arrival in the United States after traveling overseas.
Today, the Eastern District Court of Virginia rejected the government's arguments that statements made about AMP by the House Committee on Oversight and Accountability were just cause for agents to search Dr. Abu Irshaid’s devices. AMP is very grateful to the Council for American-Islamic Relations (CAIR), Gadeir Abbas, Ahmad Kaki, Catherine Keck, Elizabeth Dexter, John Fossum, and CAIR’s extraordinary legal team for defending Dr. Abu Irshaid’s rights.
“We are thrilled for Dr. Abu Irshaid and expect the searches of his phone to end following this decision,” said Ahmad Kaki, staff attorney at CAIR Legal Defense Fund.“This is an important step toward vindicating his constitutional rights, and we hope it paves the way for ending the government’s practice of targeting Palestinian activists and Muslims for these phone searches.”
Not only is this a victory for Dr. Abu Irshaid, but a victory for the pro-Palestine movement overall. For decades, allies who support Palestinian human rights have been systematically targeted by the U.S. government for daring to speak out against Apartheid Israel.
“This court ruling confirms that the government has been abusing the law to infringe upon our constitutionally protected rights, rights which are clear and not subject to arbitrary reinterpretation,” said Dr. Abu Irshaid. “The primary objective behind targeting me and others like me is to prevent us from continuing to defend the rights of the Palestinian people in the face of Israel’s machinery of genocide, which is supported by the U.S. government.”
